Title: Care and the Mandate of Law

Abstract: This seminar, co-hosted with the Durham Centre for Law and Philosophy, will examines the relationship between negligence law and the ethics of care. It argues that clinical negligence cases are fundamentally concerned with whether professionals have cared adequately for particular patients and when failures of care should attract blame. Drawing on care ethics, the seminar explores how this perspective can clarify the structure of negligence doctrine, particularly the difficult question of when courts should defer to clinical expertise in determining breach.
