Student Non-Academic Misconduct

Durham University takes student misconduct very seriously. As part of our drive to address misconduct, the University is committed to publishing the outcome of its non-academic disciplinary processes. The information below details the nature of the offence and the sanction, for cases where a student is found to have breached University disciplinary regulations.

Our non-academic misconduct procedure splits offences into two main categories:

Category 1 offences involve allegations of student misconduct which, whilst serious in nature, do not seriously affect or cause serious damage to the University, its reputation, its staff or students or the wider community. Category 1 Offences are considered less serious in nature but will warrant formal investigation and possible sanction.

Category 2 offences involve allegations of student misconduct that either do or have the potential to seriously affect or cause serious damage to the University, its reputation, its staff and students or the wider community. Category 2 Offences are considered more serious in nature and warrant investigation and possible sanction by the Senate Discipline Committee. Sanctions for Category 2 offences include exclusion from the University and other sanctions that may impact on a student’s academic progress.

Academic Year 2023/24 – Category 2 Offences

Misconduct - Category 2	Misconduct that either does or has the potential to seriously affect or cause serious damage to the University, its reputation or to its staff and students.	Prohibited from specific activities. Required to undertake community service .
Sexual misconduct and violence - Category 2	Conduct of a sexual nature which creates (or could create) an intimidating, hostile, degrading, humiliating, or offensive environment for others including making unwanted remarks of a sexual nature.	Fixed Term Exclusion. Change of College Membership. Subject to a No Contact Order.
Sexual misconduct and violence - Category 2	Engaging, or attempting to engage in a sexual act with another individual without consent. Sexually touching another person without their consent.	Expulsion.
Sexual misconduct and violence - Category 2	Sexually touching another person without their consent. Conduct of a sexual nature which creates (or could create) an intimidating, hostile, degrading, humiliating, or offensive environment for others including making unwanted remarks of a sexual nature.	Formal Reprimand. Subject to a No Contact Order. Prohibited from specific activities.

Individuals and Behaviour – Category 2	Misconduct that either does or has the potential to seriously affect or cause serious damage to the University, its reputation or to its staff and students.	Change of College membership. Subject to a No-Contact Order.
